For occupant safety, active containment zones are strictly restricted to trained technical crews wearing Level C/B personal protective equipment until final clearance verification is achieved.
1. Acceptance of Terms & Service Scope
By requesting remediation dispatch, executing a digital or paper work authorization, or granting our personnel entry to a property, you ("Client," "Property Owner," or "Authorized Representative") agree to be bound by these Terms of Service. If you do not agree with any provision herein, you must not authorize work or admit technicians to the premises.
Biohazard Cleanup Chicago ("Company") provides specialized biohazard containment, forensic cleaning, unattended death remediation, bloodborne pathogen sanitization, sewage extraction, and regulated biological waste transport throughout Chicago. Our services focus strictly on sanitization, biological hazard removal, and deodorization.
3. Containment Zones & Safety Protocols
Remediation operations are conducted in compliance with OSHA standard 29 CFR 1910.1030 (Bloodborne Pathogens) and applicable public health guidelines. To prevent cross-contamination and ensure personal health:
- Exclusion of Unauthorized Individuals: Clients, occupants, family members, pets, and contractors must remain outside established containment perimeters while active remediation is underway.
- Interference with Containment: Disabling negative-air scrubbers, breaking plastic zipper airlocks, or entering sealed rooms without supervisor permission is strictly prohibited and releases Company from contamination liabilities.
- Utility Requirements: Client agrees to ensure functioning electrical power and pressurized water on site, or notify dispatch in advance so mobile generators can be staged.
4. Porous Materials & Selective Demolition
Biological fluids, decomposition pathogens, and category 3 blackwater permeate deeply into porous construction materials. In accordance with forensic remediation guidelines, porous structural elements that cannot be completely decontaminated must be excised and disposed of as biological waste:
Such materials include, but are not limited to, contaminated carpeting, underlayment padding, saturated subflooring, drywall, trim, insulation, and non-salvageable upholstered furnishings. Client expressly authorizes technicians to perform necessary selective structural removal. Company does not provide architectural reconstruction, painting, or finish carpentry as part of remediation services.
5. Environmental Regulations & Waste Manifests
All biohazardous, anatomical, and pathological waste collected during remediation is handled in strict compliance with the Illinois Environmental Protection Act and Title 35 of the Illinois Administrative Code regarding Potentially Infectious Medical Waste (PIMW):
- Waste is packaged into puncture-resistant, leak-proof containers bearing universal biohazard warning symbols.
- Transportation is conducted exclusively via permitted medical waste haulers to state-approved autoclaving or incineration facilities.
- Official tracking manifests are maintained and provided upon request for insurance records and municipal compliance audits.
6. Insurance Coordination & Payment Responsibilities
Property owners frequently utilize homeowners, commercial property, or auto insurance policies to cover forensic remediation. When direct insurance coordination is selected:
- Direct Claims Processing: Company works directly with your insurance adjuster, submitting photo logs, chemical application records, and standard industry itemizations.
- Assignment of Benefits: Client authorizes direct disbursement of covered insurance claim proceeds to Company for remediation work performed.
- Client Deductible & Non-Covered Items: Client remains responsible for applicable policy deductibles, coverage exclusions, or any balance not reimbursed by the carrier.
- Direct Invoicing Terms: In self-pay scenarios, payment terms are due upon completion of field remediation unless alternative written arrangements have been established.
7. Limitation of Liability & Disclaimers
Company utilizes hospital-grade antimicrobial agents, advanced thermal fogging, and professional extraction equipment to achieve thorough biological decontamination. However, the nature of biohazardous incidents presents inherent structural complexities:
Company is not liable for pre-existing physical damage, biological fluid migration that transpired prior to crew arrival, structural rot concealed beneath subsurfaces, or unavoidable cosmetic alteration resulting from the removal of biohazard-soaked structural items. Under no circumstances shall Company be liable for incidental, indirect, or consequential damages resulting from property loss or temporary loss of occupancy.
8. Completion Milestones & Clearance Inspection
Upon completion of decontamination and waste packaging, a supervisor conducts a final visual assessment and delivers a formal Certificate of Remediation documenting that the area has been sanitized in accordance with professional biohazard standards.
Client or Client's authorized representative is encouraged to participate in a walkthrough verification to review treated zones prior to the departure of technical equipment and removal of exterior containment barriers.
9. Governing Law & Dispute Resolution
These Terms of Service, along with any separate written work orders, are governed by and construed in accordance with the laws of the State of Illinois.
Any dispute, controversy, or claim arising out of or relating to remediation services shall be subject to the exclusive jurisdiction of the Circuit Court of Cook County, Illinois, or the United States District Court for the Northern District of Illinois in Chicago.
